Welcome to RecovAthlete (recovathlete.com). These Terms of Service (“Terms”) govern your access to and use of our website, as well as any purchase of products from New Age Digital LLC (“we,” “us,” or “our”), operating under the brand name RecovAthlete.

By accessing this website, placing an order, or using any of our services, you agree to be bound by these Terms. If you do not agree, do not use our website or purchase our products.

Please read these Terms carefully. They contain important information about order cancellations, freight delivery requirements, warranty limitations, FDA-regulated products, and dispute resolution that directly affect your rights and obligations.

1. Definitions

  • “Products” refers to all recovery, wellness, and fitness equipment listed on recovathlete.com, including but not limited to hyperbaric chambers, infrared saunas, cold plunge units, red light therapy beds, massage chairs, whole body vibration machines, Pilates reformers, halotherapy equipment, sound therapy beds, PEMF devices, and related accessories.
  • “Customer,” “you,” or “your” refers to the individual or entity placing an order through our website or by phone/email.
  • “Manufacturer” refers to the original equipment manufacturer or authorized supplier who ships Products directly to you. This includes brands such as Lagree Fitness, OxyRevo, Luraco, Medical Sauna, BodyFriend, Merrithew, and others listed on our website.
  • “Freight Shipment” refers to products shipped via LTL (Less-Than-Truckload) freight carrier, typically items over 150 lbs or oversized dimensions.
  • “Consultation” refers to a scheduled call or meeting booked through our website (via Calendly or other scheduling tools) to discuss product selection, pricing, or custom quotes.

2. Use of the Website

By accessing and using our website, you agree to:

  • Use the website for lawful purposes only.
  • Provide accurate, current, and complete information during checkout, lead forms, consultation bookings, and quote requests.
  • Refrain from interfering with the website’s functionality, security, or performance.
  • Not reproduce, scrape, or redistribute any website content without written permission.

We reserve the right to terminate or restrict your access at our discretion, without notice, if we believe you are violating these Terms or applicable laws.

3. Product Information and Availability

We work directly with authorized manufacturers and suppliers to provide accurate descriptions, images, specifications, and pricing. However, we cannot guarantee that all information is error-free. We reserve the right to correct inaccuracies at any time without prior notice.

All Products are subject to availability. Because most Products ship directly from the Manufacturer, inventory levels can change without notice. If an item becomes unavailable after you place an order, we will notify you promptly and offer one of the following:

  • A comparable replacement product at the same or adjusted price.
  • A full refund of the purchase price.
  • A backorder with an estimated delivery timeline.

Product images may vary slightly from the actual item due to photography, screen settings, or minor Manufacturer design updates.

4. Pricing, Quotes, and Payments

4.1 Pricing

All prices are listed in USD and exclude taxes, shipping, and handling fees unless otherwise stated. Taxes and shipping costs are calculated at checkout or included in a formal quote.

We reserve the right to change prices at any time. Once you place an order and payment is confirmed, the price is locked for that transaction.

4.2 Price Match Guarantee

We offer a 120% Price Match Guarantee as described on our Price Match Guarantee page. This guarantee is subject to the specific terms and conditions stated on that page and may not apply to all products, promotions, or competitors.

4.3 Custom Quotes and Consultations

For high-ticket items, we may provide a formal quote by email, phone, or during a scheduled consultation. Custom quotes are valid for 14 days from the date of issue unless otherwise stated. After expiration, pricing may change based on Manufacturer pricing, exchange rates, or shipping cost adjustments.

Information discussed during consultations is for guidance only and does not constitute a binding agreement until a formal order is placed and payment is confirmed.

4.4 Payments

We accept Visa, Mastercard, Maestro, American Express, Apple Pay, Diners Club, and Discover. By providing payment information, you authorize us to charge the applicable amount.

4.5 Financing

We offer financing options through third-party providers including Affirm (for personal purchases) and commercial financing partners (for business purchases). Financing terms, interest rates, and approval are governed entirely by the third-party provider and are separate from these Terms. RecovAthlete has no control over financing decisions. 4.6 Payment Verification

For fraud prevention, we may verify your identity and payment method before processing high-value orders. This may include requesting a photo ID, billing address confirmation, or a brief phone call. Orders flagged for verification will not ship until verification is complete.

5. Order Processing and Cancellations

5.1 Order Confirmation

After placing an order, you will receive an order confirmation email. This confirms receipt of your order but does not guarantee fulfillment. Your order is confirmed only after payment clears and product availability is verified.

5.2 Lead Times

Most Products ship directly from the Manufacturer. Lead times vary by product category:

  • Standard items (accessories, smaller equipment): 5–15 business days.
  • Large equipment (saunas, chambers, reformers, massage chairs): 2–6 weeks.
  • Custom or built-to-order items: 4–12 weeks.

We will provide estimated delivery timelines at the time of purchase or quote. These are estimates, not guarantees.

5.3 Cancellation Policy

Before shipment: You may cancel your order for a full refund if the Manufacturer has not yet shipped the product. Contact us at info@recovathlete.com or call 866-861-6317 as soon as possible.

After shipment: Once a product has shipped, the order cannot be canceled. You may still return it under our Returns Policy, but return shipping costs and applicable restocking fees will apply.

Custom or built-to-order items: Orders for custom-built, made-to-order, or specially configured products cannot be canceled once production has begun. This will be clearly stated at the time of purchase.

Brand-specific policies: Some brands (including Lagree Fitness) have all-sales-final policies where returns are not accepted except for manufacturing defects. Brand-specific return restrictions will be communicated at the time of sale and on the relevant product page.

6. Shipping and Delivery

6.1 Shipping Methods

Products may ship via standard parcel carriers (UPS, FedEx) or LTL freight carriers, depending on the size and weight of the item. Most Products on recovathlete.com qualify for free shipping. Carrier and method are determined at the time of order.

6.2 Freight Deliveries

IMPORTANT — READ BEFORE YOUR DELIVERY ARRIVES: Many of our Products ship via freight carrier. You are responsible for the following at the time of delivery:
  1. Inspect all packaging for visible damage before signing the delivery receipt.
  2. If damage is visible, note it clearly on the delivery receipt (e.g., “Box crushed, possible damage to contents”) and take photographs.
  3. If damage is severe, you may refuse the shipment. Contact us immediately.
  4. Sign the delivery receipt as “Received with Damage” or “Subject to Inspection” if anything looks questionable.

If you sign the freight delivery receipt without noting any damage, and damage is later discovered, filing a successful freight claim becomes significantly more difficult. We strongly urge you to inspect thoroughly before signing.

6.3 Concealed Damage

If damage is discovered after delivery (concealed damage), you must notify us within 48 hours of receiving the shipment. Include photographs of the damage and all original packaging materials. We will work with the freight carrier and Manufacturer to resolve the issue, but claims reported after 48 hours may not be honored by the carrier.

6.4 Delivery Address and Access

You are responsible for providing a correct and complete delivery address. Re-delivery charges or return shipping costs caused by incorrect address information are your responsibility.

6.5 Liftgate and Inside Delivery

Freight deliveries are curbside by default. If you need liftgate service, inside delivery, or white-glove delivery, you must request this at the time of order. Additional fees may apply.

7. Returns and Refunds

If you are not satisfied with your purchase, you may be eligible for a return. Returns are subject to the following conditions:

  • You must contact us within 30 days of delivery to initiate a return.
  • The product must be unused, in its original packaging, and in resalable condition.
  • Return shipping costs are your responsibility unless the return is due to our error or a defective product.
  • A restocking fee of up to 20% may apply for non-defective returns on large equipment.
  • Custom-built, made-to-order, or specially configured products are non-returnable.
  • Certain brands have all-sales-final policies. See the product page or contact us for brand-specific return terms.

Refunds will be processed to the original payment method within 10–15 business days after the returned product is received and inspected.

8. Warranty Coverage

8.1 Manufacturer Warranty

Most Products sold on RecovAthlete come with a Manufacturer’s warranty. Warranty duration, coverage, and terms vary by product and brand. Specific warranty details are listed on each product page and on our Warranty page.

8.2 Brand-Specific Warranty Variations

Different brands have different warranty policies. For example, Lagree Fitness equipment carries a one-year warranty on manufacturing defects under their all-sales-final policy. Other brands may offer warranties of 2–10 years or more. Always check the specific product page for warranty details.

8.3 Warranty Claims

Warranty claims are processed through the Manufacturer. We will assist you in connecting with the Manufacturer and facilitating the claims process, but the final warranty decision rests with the Manufacturer.

8.4 What Is Not Covered

Warranties typically do not cover:

  • Damage caused by misuse, improper installation, or failure to follow the Manufacturer’s instructions.
  • Normal wear and tear.
  • Cosmetic damage that does not affect functionality.
  • Damage caused by unauthorized modifications or repairs.
  • Products used in commercial settings if the warranty specifies residential use only (or vice versa).

8.5 No Additional Warranty

RecovAthlete (New Age Digital LLC) does not provide any warranty beyond what the Manufacturer offers. We make no additional representations or guarantees regarding product performance, durability, or fitness for a particular purpose beyond the Manufacturer’s stated warranty.

9. FDA and Health Disclaimers

Some Products sold on recovathlete.com, including hyperbaric chambers, red light therapy devices, and PEMF devices, may be classified as wellness devices or medical devices subject to FDA regulation.

  • Product descriptions on our website are provided for informational purposes only and are not intended as medical advice.
  • We do not claim that any Product can diagnose, treat, cure, or prevent any disease unless the product holds specific FDA clearance for that use.
  • Consult a qualified healthcare professional before using any recovery or wellness equipment, especially if you have a pre-existing medical condition.

10. Installation and Use

Some Products require professional installation, electrical work, plumbing, or structural modifications. You are solely responsible for:

  • Ensuring your space meets the product’s requirements (electrical capacity, ventilation, floor load capacity, doorway clearance, etc.).
  • Hiring qualified professionals for installation when recommended by the Manufacturer.
  • Following all Manufacturer instructions for setup, use, and maintenance.

RecovAthlete is not responsible for damage, injury, or product failure resulting from improper installation or use.

11. Commercial and B2B Purchases

We sell Products to businesses including gyms, clinics, medspas, chiropractic offices, and wellness centers. The following additional terms apply to commercial purchases:

  • Commercial buyers are responsible for verifying that Products meet any applicable regulatory, licensing, or zoning requirements for their facility.
  • Warranty terms may differ for commercial use. Check the specific product page or contact us to confirm commercial warranty coverage before ordering.
  • Volume pricing and custom quotes for commercial buyers are available by booking a consultation or contacting us directly.

12. Promotions and Discounts

We may offer promotional discounts including our Everyday Heroes Discount, cart-based percentage discounts, and seasonal promotions. Unless otherwise stated:

  • Promotions cannot be combined with other offers or the Price Match Guarantee.
  • We reserve the right to modify or discontinue any promotion at any time without notice.
  • Promotional pricing does not apply retroactively to orders already placed.

13. Affiliate Program

RecovAthlete operates an Affiliate Program. Affiliates are subject to separate terms and conditions provided at the time of enrollment. Participation in the affiliate program does not create an employment, partnership, or agency relationship with New Age Digital LLC.

14. Intellectual Property

All content on recovathlete.com, including text, images, logos, graphics, videos, and product descriptions, is the property of New Age Digital LLC or our licensors and is protected by copyright and trademark laws. You may not copy, distribute, reproduce, or create derivative works from any content without our written permission.

15. Limitation of Liability

To the fullest extent permitted by law, New Age Digital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use or inability to use the website.
  • Errors or inaccuracies in product descriptions or specifications.
  • Delayed or failed deliveries due to third-party carriers or Manufacturers.
  • Product defects, malfunctions, or performance issues covered under the Manufacturer’s warranty.
  • Improper installation, misuse, or modification of Products.
  • Loss of business, revenue, or anticipated savings.
  • Health outcomes from the use of any wellness or recovery equipment.

Our total liability for any claim related to a Product shall not exceed the amount you paid for that specific Product.

16. Indemnification

You agree to indemnify and hold harmless New Age Digital LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the website or Products.
  • Your violation of these Terms.
  • Any third-party claims related to your use of the Products.

17. Force Majeure

We are not liable for delays or failure to perform any obligation under these Terms caused by circumstances beyond our reasonable control. This includes natural disasters, pandemics, government actions, supply chain disruptions, shipping carrier delays, labor disputes, or Manufacturer production delays.

In the event of a force majeure, we will notify you of the delay and work to fulfill your order as soon as reasonably possible.

18. Dispute Resolution

18.1 Good Faith Resolution

Before pursuing formal legal action, you agree to contact us at info@recovathlete.com or call 866-861-6317 to attempt to resolve any dispute informally. We will make a good faith effort to address your concern within 30 days.

18.2 Chargebacks

We ask that you contact us directly before initiating a chargeback with your credit card company. Many issues can be resolved faster through direct communication. Filing a chargeback without first contacting us may delay resolution and result in additional costs.

18.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in the State of Wyoming for any disputes not resolved informally.

19. Privacy Policy

20. Third-Party Links and Services
